Terms & Conditions of Ticket Purchase and Event Attendance
Welcome to Bay Area Kirtans! By purchasing a ticket and/or attending “An Evening of Mantra Music with Madhava Das” (the “Event”) organized by Milpitas Gita Circle (“Organizer”, “we”, “us”, or “our”), you (“Ticket Holder”, “Attendee”, or “you”) agree to the following Terms and Conditions. Please read them carefully before completing your purchase.
1. No Refunds and Final Sales
All ticket sales are final. Tickets are strictly non-refundable and non-exchangeable for any reason, including but not limited to personal schedule changes, illness, or general inability to attend.
If you cannot attend, you may transfer your ticket to another individual. Please contact the organizers via WhatsApp prior to the event to update the attendee name.
2. Event Cancellation or Postponement
In the rare event of cancellation or postponement by the Organizer due to unforeseen circumstances (e.g., artist illness, facility issues, extreme weather), the Organizer reserves the right to either reschedule the Event or provide a refund at its sole discretion.
The Organizer is not responsible for any travel, accommodation, or other incidental expenses incurred by ticket holders due to cancellation or postponement.
3. Food and Dietary Disclaimer (Vegetarian Dinner)
A complimentary vegetarian (Sattvic) dinner is included with your ticket purchase. While we strive to prepare clean and wholesome food, the Organizer cannot guarantee the complete absence of common food allergens (such as nuts, dairy, gluten, or soy).
Attendees with severe food allergies participate at their own risk. By consuming the food provided, you release the Organizer, venue, and volunteers from any liability relating to allergic reactions or food-borne illness.
4. Venue Rules and Code of Conduct
The Event takes place at Curtner Elementary School (Milpitas, CA). All attendees must respect school property and adhere to local facility regulations.
Supervision: Children of all ages are welcome, but children (including kids 6 and under who receive free admission) must be supervised by a parent or legal guardian at all times.
Right of Refusal: We reserve the right, without refund, to refuse admission to or eject any person whose conduct is deemed disorderly, unsafe, or disruptive to the spiritual atmosphere of the community.
5. Liability Waiver and Release
By entering the Event, you voluntarily assume all risks incidental to the Event, including the risk of personal injury, illness, or property damage/loss.
You hereby release, waive, and hold harmless Milpitas Gita Circle, its organizers, volunteers, artists (including Madhava Das), and the Milpitas Unified School District from any and all claims, demands, or liabilities arising from your attendance.
6. Media, Photography, and Recording Release
By attending this community event, you acknowledge that professional photography, audio recording, and video recording will take place.
You grant Milpitas Gita Circle the irrevocable right to use your likeness, image, or voice in promotional materials, social media, websites, or future event marketing without financial compensation or prior approval.
7. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California.
